Drug Distribution in Texas

Counsel from a Knowledgeable Irving Criminal Defense Attorney

Those who are arrested for drug possession in Texas can usually garner some valuable considerations from the court: they are merely the customer of an illegal enterprise, who possibly is struggling with an addiction issue. These considerations, however, are unavailable to those who are found accused of drug distribution. In the eyes of the law, these individuals are participants in a larger drug economy and deserving of harsh felony penalties.

If you have been charged with the manufacture or delivery of a controlled substance, then the time to seek legal counsel is now. At J. Roland Jeter, P.C., clients can count on unparalleled experience in their corner when facing a serious criminal allegation. "How serious is my charge?"

In TEX HS. CODE ANN. § 481, drug distribution is defined as the "manufacture of delivery of a substance." Like other drug statutes, these laws are complex and depend on many factors, such as the suspect's criminal history, the quantity of the substance found, and the type of substance found. Texas classifies illegal substances in different categories called penalty groups.

Some of the substances included in each penalty group include:

  • Group 1: heroin, cocaine, methamphetamine, oxycodone
  • Group 1A: LSD
  • Group 2: PCP, ecstasy, mescaline
  • Group 3: Valium, Ritalin, Xanax,
  • Group 4: substances containing Motofen, Dionine, and other chemicals

The manufacture of delivery of a substance is always considered either a first or second-degree felony. To learn more about the specifics of your charge, what penalties you may be facing, and how J. Roland Jeter, P.C. can ensure that every viable defense avenue is aggressively pursued, contact the firm today.
