Division of Marital Property

Divorce in the state of Texas requires that couples divide their “community property” in a way that is “just and right,” which does not necessarily mean perfectly even. Community property is essentially anything that is acquired during the marriage and therefore belongs to both spouses. Any property that was acquired individually before the marriage and belongs to each spouse separately is usually exempt from division in this way.

Community property can include:

  • Cars
  • Home furnishings
  • Bank accounts
  • Electronics
  • Home equity
  • Employment benefits

As you can see, not all community property is physical, and often times these non-physical possessions are some of the most difficult to fairly divide. This process may take a considerable amount of patience and knowledge of the law to be able to navigate successfully. Make sure you are prepared for your case by contacting a skilled attorney and having them assist you throughout the process.
