In TEX HS. CODE ANN. § 481, drug distribution is defined as the "manufacture of delivery of a substance." Like other drug statutes, these laws are complex and depend on many factors, such as the suspect's criminal history, the quantity of the substance found, and the type of substance found. Texas classifies illegal substances in different categories called penalty groups.

Some of the substances included in each penalty group include:

  • Group 1: heroin, cocaine, methamphetamine, oxycodone
  • Group 1A: LSD
  • Group 2: PCP, ecstasy, mescaline
  • Group 3: Valium, Ritalin, Xanax,
  • Group 4: substances containing Motofen, Dionine, and other chemicals
