Division of Marital Property
Divorce in the state of Texas requires that couples divide their “community
property” in a way that is “just and right,” which does
not necessarily mean perfectly even. Community property is essentially
anything that is acquired during the marriage and therefore belongs to
both spouses. Any property that was acquired individually before the marriage
and belongs to each spouse separately is usually exempt from division
in this way.
